Question by WeepingHead: dhs foster care custody help?
My husbands nieces have been in dhs care for the last 2 years, we just recently found out about it and have been trying to get custody of them, they have been with the same foster parent for the entire time they have been in care, but DHS has said that they have to place with kin, but since the girls have been with their current placement for so long she has the right to file a motion to stop the move and go to court to have a judge decide the fate of the girls. They are 5 and 6 and have seemed happy with coming over for their weekend visits. At first the foster mom told us that she was not going to appeal the move and now she is. We didn’t know the girls prior to finding out 3 months ago that they were in care, and they are naturally having some issues with not wanting to move from where they are now. Anyone have any ideas as to what chances of us actually might be of going to court and being awarded custody. And how you would go about trying to find a good custody lawyer.

you should fight for children
the foster mother is receiving money from the state for each child and does not want to let that money go – would you ?
don’t talk to dhs without an attorney present – they never tell the truth (my personal experience)
you did not mention your state, so it is hard to recommend a good lawyer

Get a lawyer and try to get them back.
They don’t want the girls to go because they get money and unfortunatly thats what alot of people think about instead of the welfare of the children. They need to be with family who are capable of caring and loving for them. And if you can then go for it and fight for them. They need you more then a foster system.
